Grant of Probate

Often the surviving spouse, or a solicitor, will typically need to gather a series of documents to settle the estate. These usually include the late spouse's will, death certificate, identification papers, insurance policies and bank and credit-card statements, as well as the couple's marriage license. In the U.K., the executor will typically need to apply for a Grant of Probate or Letter of Administration. To do this, the executor will need to value the estate of the deceased and complete an inheritance tax return. Any inheritance tax due must be paid before a grant can be issued. The surviving spouse may need a certified copy of the death certificate to apply for life insurance proceeds and to qualify for bereavement benefits. In India, an application of probate must be made by petition to an appropriate court (District Court or High Court).
